Shareholders are sometimes considered to be, in moral terms, the owners of a company, they are after all the carriers of the residual liabilities and bear a higher proportion of the financial risk. However, in company law, the shareholders’ responsibility is limited, and in financial terms shareholders are only liable up to the fully paid value of the share certificate. Moreover, when the shares are sold, the responsibility and risk are transferred completely to the new bearer of the shares. Whether (...) this gap in moral and legal perceptions can be judged to be satisfactory in business ethics terms is a moot point and will be partly explored in this case study which seeks to analyse the shareholder’s responsibility towards a firm in which they own shares. The case study company chosen as a vehicle to explore these issues is that of Turner & Newall; a company that subjected its employees, communities and customers to a major health hazard – asbestosis. This paper will use the Turner & Newall archive materials to illustrate the moral hazards that can arise for shareholders. In particular it will examine the ethical responsibilities of shareholders towards those stakeholders who were exposed to the dangers of asbestos. This case is a significant test of the veracity of the legal system of company control, and exposes the ineffectiveness of that system in accountability terms. The case study also deals with specific issues that arose in the asbestos crisis, as well as with more general issues in our present system of corporate governance and shareholder responsibilities. This essay examines the ways narratives succeed or fail to provide a life with structure and direction, as exemplified in Louisa May Alcott's "Little Women" and George Eliot's "Middlemarch". Whether a narrative can be a moral compass depends on the presence of what Eliot calls "a coherent social faith." The debate between Edmund Burke and Thomas Paine provides a framework for my analysis of the problematic status of such a social faith in the modern world. This analysis in turn sheds (...) light on contemporary work on narrative, community, and ethics by Hans Frei, Stanley Hauerwas, George Lindbeck, and Alasdair MacIntyre. (shrink)

Two of the most influential arguments in favour of the permissibility of abortion were put forward in the latter half of the twentieth century by Judith Jarvis Thomson and Mary Anne Warren. The implications of these arguments for unwilling putative fathers have largely not been considered. Some have argued that Thomson's defence of abortion might allow a man under certain circumstances to terminate his parental responsibilities and rights. To my knowledge, nobody has considered the implications of Warren's argument for men. (...) I will consider the implications of both arguments for men. I will argue that if they are successful defences of abortion then they are also successful in justifying a male counterpart to abortion which I label ‘elective abandonment’. I will not be defending or attacking these arguments as defences of abortion, but will defend the claim that they apply as well to elective abandonment as they do to abortion. (shrink)

This paper examines the lawsuits brought by state and local government entities against prescription opioid producers and sellers. It examines their potential liability as well as some of the defenses they might raise. The paper also discusses multidistrict litigation and government lawsuits in state court. It concludes that litigation is not the best solution to the opioid crisis.

Richard Jeffrey is beyond dispute one of the most distinguished and influential philosophers working in the field of decision theory and the theory of knowledge. His work is distinctive in showing the interplay of epistemological concerns with probability and utility theory. Not only has he made use of standard probabilistic and decision theoretic tools to clarify concepts of evidential support and informed choice, he has also proposed significant modifications of the standard Bayesian position in order that it provide a (...) better fit with actual human experience. Probability logic is viewed not as a source of judgment but as a framework for explaining the implications of probabilistic judgments and their mutual compatability. This collection of essays spans a period of some 35 years and includes what have become some of the classic works in the literature. Recent publications focused on Arabic/Islamic philosophy have traditionally considered this under the history of ideas and Oriental or Islamic studies. There is a need for a comprehensive collection of essays that treats Islamic philosophy as philosophy, and not merely as a conduit of intellectual history for delivering ideas from the ancient Greeks to medieval Christians. In his seminal 1935 study of the internal senses in medieval2 thought, Harry Austryn Wolfson presented a detailed account of the development of the "classification and terminology" of the Greek, Arabic, Hebrew and Latin traditions on sensory powers which he called, "post-sensationary faculties,"~ that is, powers which are posterior to the five external senses. In explaining the complex development of teachings on the internal senses from Aristotle's texts, Wolfson recounted the Aristotelian understanding of Galen who specifically locates the OHXVOTl'ttKOV or (...) cogitative faculty in the middle ventricle of the brain and John of Damascus whose equally Aristotelian account follows the Stagirite in attributing judgments of goodand bad as well as combination and separation of ideas to the omvoTl'ttKTJ 'lfUXTt or the cogitative soul and to ouxvma or cogitation.4 One of the many fruits of Wolfson's discussion was an explanation of the development of the Avicennian doctrine of estimation as arising"out of a desire to supplement a deficiency which seemed to exist in Aristotle's account of the actual motion of pursuit and avoidance which is observed in both man and animal. "5 With wahm used to describe instinctive behavior consequent upon non-rational animal imagination analogous to human reasoning or deliberation, Wolfson wrote, the Arabic fikr now was tobe associated with imagination and no longer was to be seen as simply the power of combining and separating ideas. "In the case of ouivotcx combined with imagination, it is the combination and separation of images, i.e., the construction out of images of things existent, new composite images of things nonexistent, or the breaking up of images of things existent into images of things nonexistent."6 From this moment on, and not without some foundation in Aristotle's own texts as indicated, fikr/ cogitatio and their related derivative terms are used to characterize human rational powers which are essentially activities involving the bodyand bodily instruments insofar as imagination is necessarily bodily. This paper makes the case for using the independent non-executive directors of a company listed in the United Kingdom exclusively as monitors and regulators of management, particularly as regulators of executive directors’ conflicts of interest, rather than as participants in management who also have a control function. It is suggested that these proposals can be accommodated within current corporate law in the United Kingdom, that they are practicable, and that they are desirable. The proposals are made against the background of (...) a continued strong emphasis in the United Kingdom on non-executive directors’ dual role both as managers of a company’s business and as monitors of its executive directors. It is suggested that this dual role for non-executive directors tends significantly to undermine the effectiveness of their control function, and that consequently the dual role should be abandoned in favor of the more focused role proposed in the paper. Improving the effectiveness of non-executive directors as regulators of executive directors’ conflicts of interest is vitally important to corporate governance in the United Kingdom: as the paper explains, other legal methods of controlling those conflicts in the United Kingdom suffer from serious deficiencies. Tarski's correspondence theory of truth (which he spells out in his semantic conception of truth) is open to two interpretations. This ambiguity in the theory has led philosophers to find support in it for metaphysical realism. In fact, Tarski's theory turns out to support a form of ontological relativism. In different passages Tarski himself gives support to each of these interpretations. The first interpretation leads to ontological relativism, while the second sacrifices the connection between language and the world. I clarify (...) the dilemma that I see in having to choose between these two interpretations, explain how these interpretations have their source in different problems which occupied Tarski, and consider a possible solution to the dilemma. Finally, finding good reasons to claim that Tarski's theory is indeed a correspondence theory of truth, I argue in favour of the first interpretation with its relativistic implications. (shrink)

Launched in 1971, _Adolescent Psychiatry_, in the words of founding coeditors Sherman C. Feinstein, Peter L. Giovacchini, and Arthur A. Miller, promised "to explore adolescence as a process...to enter challenging and exciting areas that may have profound effects on our basic concepts." Further, they promised "a series that will provide a forum for the expression of ideas and problems that plague and excite so many of us working in this enigmatic but fascinating field." For over two decades, _Adolescent Psychiatry_ has (...) fulfilled this promise. The repository of a wealth of original studies by preeminent clinicians, developmental researchers, and social scientists specializing in this stage of life, the series has become an essential resource for all mental health professionals working with youth. Volume 20 of the series serves as a tribute to editor emeritus Sherman C. Feinstein. In addition to an appreciation of, and contributions by, Dr. Feinstein, it contains heretofore unpublished papers by two other major figures in adolescent psychiatry, founding father William Schonfeld and a Viennese colleague transplanted to America, Siegfried Bernfeld. With sections on general considerations of adolescence, specific syndromes, and treatment modalities, volume 20 presents the work of many of today's preeminent minds in adolescent psychiatry. Here a suggestion for coding imputations of influence into the kinematics of judgmental probabilities is applied to the treatment of Newcomb problems in The Logic of Decision framework. The suggestion is that what identifies you as treating judgmental probabilistic covariance of X and Y as measuring an influence of X on Y is constancy of your probabilities for values of Y conditionally on values of (...)
